Court of King's Bench Alberta Rules the Restrictive Covenant Remains Enforceable

Judge Johnston of Court of King's Bench Alberta released her decision today June 19, 2023 on whether  or not the Restrictive Covenant preventing further non golf-related development remains enforceable.

In her written 13 page written judgment, Judge Johnston indeed confirmed on all arguments that the Restrictive Covenant is valid and remains enforceable, and dismissed the Cochrane Golf Club application. The Town of Cochrane and Jennifer Foy et al have prevailed (so far).

The Cochrane Golf Club has 30-days in which to file an Appeal, should they chose to (likely). 

Cost recovery requests to be submitted in 30 days.
